Choosing an executor or trustee is a critical decision. This individual or entity will be responsible for managing your estate according to your instructions outlined in your will or trust.
Consequently, you need someone trustworthy, organized, and capable of handling financial matters. Moreover, they should be comfortable communicating with beneficiaries and navigating the legal complexities involved.
I often advise clients to consider family members, close friends, or even professionals like attorneys or financial advisors. It’s important to have open conversations with potential candidates about their willingness and capacity to fulfill this role.
Ordinarily, I recommend choosing a backup executor or trustee as well, in case the primary appointee is unable or unwilling to serve.
I recall a situation where a client named a sibling as executor, but due to unforeseen personal circumstances, that sibling was unable to fulfill the role. Fortunately, we had designated a backup executor who stepped in seamlessly and ensured the estate was properly managed.
