Choosing the Right Trust for Your Needs
Today, we’re joined by Steve Bliss, a well-respected probate attorney here in San Diego. Steve, thank you for taking the time to speak with us.
It’s my pleasure. I’m always happy to discuss estate planning and the importance of protecting your assets.
The Power of Trusts
For those unfamiliar, can you explain what a trust is and why someone might need one?
A trust is essentially a legal arrangement where a trustee holds and manages assets for the benefit of beneficiaries. There are many different types of trusts, each serving specific purposes. One common type is the revocable living trust.
Revocable Living Trusts: A Flexible Solution
Could you elaborate on revocable living trusts? What makes them so popular?
Revocable living trusts are indeed very popular because they offer a great deal of flexibility. The grantor, the person who creates the trust, retains control over the assets during their lifetime and can modify or revoke the trust as needed. Consequently, it’s a good option for people who want to avoid probate, maintain privacy, and ensure their assets are distributed according to their wishes.
Moreover, because the assets are held in the trust, they don’t become part of the grantor’s taxable estate upon death. This can potentially save on estate taxes, a significant benefit for many individuals.
Challenges and Considerations
Are there any common challenges or misconceptions people have about revocable living trusts?
One misconception is that they are only for the wealthy. While they can be beneficial for high-net-worth individuals, anyone with assets they want to protect and pass on efficiently can benefit from a revocable living trust.
I remember working with a young couple who had just purchased their first home. They were worried about what would happen to their property if something happened to one of them. We set up a revocable living trust, giving them peace of mind knowing their home would be protected and pass seamlessly to the surviving spouse.
It’s important to remember that trusts are complex legal documents, so it’s crucial to work with an experienced attorney who can tailor one to your specific needs.
The Importance of Planning Ahead
What advice would you give to someone considering a trust?
Don’t wait! Start planning early. The sooner you set up a trust, the better protected your assets will be and the less stress you’ll face in the future. According to a recent study by the AARP, over 60% of Americans don’t have a will or estate plan in place.
