What are some of the most common types of trusts used in estate planning?

There are several different types of trusts, each with its own set of advantages and disadvantages. One of the most common is the Revocable Living Trust. It allows you to maintain control over your assets during your lifetime while avoiding probate – a lengthy and often expensive legal process.

Accordingly, a Revocable Living Trust offers privacy as it doesn’t become public record like a will. Consequently, your financial affairs remain confidential. Moreover, upon your passing, the trust assets are distributed according to your wishes without going through the court system.

Can you elaborate on some of the benefits of a Revocable Living Trust?

Absolutely. As I mentioned, avoiding probate is a major advantage. Probate can be time-consuming and costly for your heirs. A trust allows for a smoother transfer of assets. Let me tell you about a client who came to me after his father passed away without a will. His family was thrown into a legal quagmire, struggling with court proceedings and hefty legal fees. He wished his father had taken the steps to set up a Revocable Living Trust.

Notwithstanding the initial effort involved in setting up a trust, it ultimately saves your loved ones considerable heartache and expense down the road. Another benefit is privacy; a trust doesn’t become public record like a will does. Your financial affairs remain confidential. Approximately 70% of Americans die without a valid will or trust, leaving their families vulnerable to unnecessary complications and expenses (Source: AARP).
