Good evening, Moreno Valley and welcome back to Legal Matters. I’m your host, Sarah Jones. Tonight, we have the pleasure of speaking with local probate attorney, Steve Bliss of Moreno Valley Probate Law. Mr. Bliss, thank you for joining us.
Understanding Trust Options
Steve, many people are unfamiliar with trusts and how they can benefit their estate planning. Can you tell our viewers a little about some common types of trusts?
Certainly, Sarah. Trusts are powerful tools that allow individuals to manage and distribute their assets according to their wishes. One common type is the Revocable Living Trust. This trust allows the creator, known as the grantor, to retain control over their assets during their lifetime while avoiding probate upon their passing.
Conversely, an Irrevocable Trust cannot be modified once established. It’s often used for asset protection or tax planning purposes. Another option is a Testamentary Trust, which is created through a will and comes into effect after the grantor’s death.
Benefits of a Revocable Living Trust
You mentioned the Revocable Living Trust. Can you elaborate on its advantages and how it might benefit our viewers?
Absolutely. A Revocable Living Trust offers several key benefits. Firstly, it allows for probate avoidance, sparing your loved ones from a lengthy and often costly legal process. Moreover, it provides privacy since the terms of the trust are not public record, unlike wills.
Consequently, you have greater control over how and when your assets are distributed to your beneficiaries. You can specify conditions, such as requiring beneficiaries to reach a certain age or achieve specific milestones before receiving their inheritance. Ordinarily, this level of customization is not possible with a simple will.
Challenges and Considerations
Are there any potential challenges or considerations that individuals should be aware of when setting up a Revocable Living Trust?
While Revocable Living Trusts offer many advantages, it’s important to remember they require careful planning and execution. Notwithstanding their benefits, improper drafting or funding can lead to unintended consequences.
I recall one instance where a client attempted to create their own trust using online templates. Unfortunately, they overlooked crucial details regarding asset titling and beneficiary designations, ultimately leading to complications in administering the trust after their passing.
This highlights the importance of seeking professional legal guidance when establishing a trust. An experienced probate attorney can ensure your trust is properly structured and tailored to your specific needs and circumstances.
