“If probate is needed, we file a petition with the court, provide notice to heirs and creditors, and then gather all the estate’s assets. We pay any debts and taxes owed, and finally, distribute the remaining assets to the rightful beneficiaries. It’s a multi-step process that can take several months to complete.”

  • I though VIII: Close the Estate: Ted emphasizes the importance of this final step. “Once all debts are paid and assets distributed, we file a Petition for Final Distribution with the court,” he explains. “After receiving court approval, we file final receipts and officially close the probate case.”

“Closing the estate ensures everything is finalized and that there are no loose ends,” Ted adds. “It provides closure for the family and allows them to move forward knowing all legal obligations have been met.”

Any Hiccups?

I ask Ted if he’s ever encountered any challenges during this final stage of probate. He chuckles and recounts a story about a client who misplaced crucial receipts, leading to a delay in the case while they were located.

“It was a good reminder that organization is key throughout the entire probate process,” Ted says with a wink.

“Another time, we had a dispute arise between heirs regarding the distribution of personal property. Thankfully, we were able to mediate the situation and reach a mutually acceptable agreement.”
