Let’s talk about one specific step in the probate process – handling debts and taxes. How does that work?
That’s a critical stage, Brenda. As executor or administrator of the estate, you’re responsible for identifying and paying valid creditor claims. This often involves reviewing bills, contacting creditors, and verifying the legitimacy of each claim.
It’s important to note that you only pay debts that are proven and legitimate. Sometimes, creditors may make claims that are outdated or unsubstantiated. You have a duty to scrutinize these carefully.
In addition to paying creditors, you’ll also need to file and pay any applicable federal and state taxes on the estate. This can be complex, involving estate tax returns and potentially income tax filings for the decedent.
Notwithstanding the complexities, a thorough and organized approach is key. I always advise clients to keep meticulous records of all financial transactions related to the estate.
I’ve encountered situations where heirs were unaware of significant debts incurred by the deceased. This can lead to unexpected financial burdens on those inheriting the estate. In one instance, a family was surprised to discover a substantial medical debt they had no knowledge of.
