Unlike a living trust, which takes effect immediately, a testamentary trust is outlined in a person’s will and only becomes active after they pass away. It then goes through probate, which is the legal process of validating a will and distributing assets.
Testamentary trusts are particularly useful when someone wants to provide for beneficiaries who may not be able to manage their inheritance responsibly, such as young children or individuals with special needs. The trustee named in the will manages the assets according to the grantor’s instructions, ensuring that the funds are used appropriately and for the beneficiary’s benefit.
Conversely, a living trust avoids probate altogether, making it a more efficient way to distribute assets after death. However, testamentary trusts offer greater flexibility in controlling how and when beneficiaries receive their inheritance.

One situation that comes to mind involved a single mother who wanted to ensure her young son would have financial security after her passing. She was concerned about him inheriting a large sum of money at a young age and potentially making unwise decisions. We worked together to create a testamentary trust that would provide for his education expenses, living costs, and eventual transition into adulthood.
Moreover, the trust stipulated that he wouldn’t have access to the entire inheritance until he reached a certain age, mitigating the risk of premature spending. It was incredibly rewarding to help her create a plan that gave her peace of mind knowing her son would be well cared for in the future.
